Xzibit was hit with a temporary restraining order after a man who previously worked for him claimed he threatened to kill him if he helped his ex in their divorce battle but the rapper strongly denied the accusations, In Touch can exclusively report.
According to court documents obtained by In Touch, Julio Garcia, who claims he washed the musician’s cars for years, filed a petition for a restraining order on February 25.
In the filing, Julio asked that Xzibit (real name: Alvin Joiner) be ordered to stay 100 yards away from him, his wife, his daughter and Krista Joiner, who is Xzibit’s ex-wife and Julio’s “employer.”
As In Touch first reported, Xzibit, 50, and Krista are in the middle of a bitter divorce and are preparing to face off at trial. Krista recently accused Xzibit of failing to pay his court-ordered child support and spousal support for December 2024. The case is ongoing.
Through his attorney, Xzhibit claims that he has “provided financial support in accordance with his legal obligations and has made every effort to ensure the well-being of his child. Despite this, [Krista] has deliberately and falsely portrayed him as neglectful and irresponsible in an apparent attempt to damage his reputation and alienate him from his son. These claims are not only demonstrably false but also deeply harmful.”
The case between Xzhibit and Krista is ongoing.
In Julio’s petition, he claimed Xzibit “threatened to kill” him if he testified and told Krista “the truth about what” he “learned when [he] washed his cars.”
Julio said he learned “what vehicles he has, where he has them, where his new house is” and he even gained information when he “helped [Xzibit] move cannabis merchandise from Las Vegas to Chatsworth, and where the warehouse is.”
Julio said Xzibit told him that he would kill him and then told him, “Good luck to you and Krista.”
In Touch obtained a letter Xzibit’s attorney sent Krista, where he accuses his ex-wife of “manipulat[ing] witnesses through coercion and intimidation.”
Xzibit further states that Krista “directly or indirectly threatened third-parties with legal and immigration-related consequences if they did not provide statements favorable to [her].” It remains unclear if Xzibit is referring to Julio or another third-party in his accusations.
Krista’s legal team told In Touch, “In response to the entry of the Restraining Order and personal service of the Restraining Order on Mr. Joiner, his lawyers at the law firm Offit Kurman sent two letters to Krista’s three lawyers. The Offit Kurman firm alleges that Krista’s lawyers have broken the law, intimidated witnesses, and committed other misconduct. The Offit Kurman partner, Victor Balladares, threatened to report all three of Krista’s counsel to the State Bar, the Attorney General, the District Attorneys’ Office, and the Department of Justice. In response, Krista’s attorneys referred Mr. Joiner’s counsel to the sworn declaration of Mr. Garcia, who provided first-hand information about the statements and conduct of Mr. Joiner as well as the location of certain assets that had been so far concealed from or not disclosed to Krista. “
In his declaration, Julio explained he has worked for Xzibit and Krista for many years.
He said once the divorce started, Krista paid him for his work but Xzibit “paid me only from time to time and often, he did not pay me.”
Julio further claims that at times, “[Xzibit] did not pay me, but expected me to wash his many cars.”Julio claimed Xzibit asked him to help move a large amount of cannabis merchandise in the summer of 2024.
“There were three large trucks. I personally worked until 2 a.m. unloading the trucks. This was very hard work,” he said.
“After that, I washed Krista’s cars at her home,” Julio said. “She asked me to tell her where the house was that [Xzibit] had recently purchased for himself.”
Julio said Krista also asked where the warehouse was where he unloaded the merchandise. “At the time, I did not know or understand that what [Xzibit] was doing was a secret,” he said. “In the last three weeks, two different woman have come to my home to look for me, apparently to serve me with a subpoena to testify in the divorce.”
Julio said after the last visit from an attorney in February, he said he called Xzibit to tell him he “had nothing to do and nothing to say about his divorce, and reminded him that he still owed [Julio’s company] a substantial amount of money for the car washed he had not paid.”
“[Xzibit] told me that he would pay me and asked for video of the attorney who came to my house. He was angry and very demanding. He asked me for the videos over and over again. [Xzibit] was very angry that I did not give him the videos, but I told him he had to pay my bills first if he expected any help from me,” Julio explained.
Julio claimed Xzibit told him he would pay the bill, but he did not actually pay it. “It seems like he lies about everything,” Julio said. Later, Julio said he met up with Xzibit in person.
He claimed the musician took his phone and started “writing a text to himself as if I had written the text, to invent a truth that did not exist.”
In addition, he claimed Xzibit recently told him he should not give Krista any more information. “I told him that if he wanted my help, he should not do that, especially since he had not had the decent to pay my bill,” Julio said.
He continued, “I am a hardworking man and cannot give away thousands of dollars of service for free. [Xzibit] told me he would pay me in cash, but only if I gave him the videos of the woman lawyer and if I did not cooperate in giving information to Krista about him that I learned while I was working for him.”
Julio said, “When I said that I did not see any reason that I should help [Xzibit]. [Xzibit] told me that if I talked to Krista and gave her information, ‘I will kill you.’”
Julio wrote, “This made me very scared. I also felt it was an incredible lack of respect, particularly since I had kept washing his cars over the years without payment.” In his declaration, Julio said he contacted Krista and her lawyer at the Santa Clarita Sheriff’s Station on February 24, where he made a formal report of Xzibit’s alleged death threat and his “interfere with my testimony as a witness.”
A temporary restraining order was granted which requires Xzibit to stay away from Julio and not contact him.
The judge did not add Krista as a protected person in the order. A hearing has been set for March 19 to determine whether the order will become permanent.
