Shelley Duvall’s longtime partner, Dan Gilroy, and her brothers worked out a settlement as part of the fight over her six-figure estate, In Touch can exclusively report.
According to court documents obtained by In Touch, on March 27, Dan and Shelley’s family informed the court of the deal. The deal notes Shelley did not have a will when she died on July 11, 2024, at the age of 75.
The agreement said Dan and Shelley’s brothers will all receive a cut of her estate, despite her family previously attempting to cut Dan out. Dan was awarded one-half of Shelley’s separate real property and the brothers each received a 1/6 cut.
The actress’ two brothers will be appointed administrators of her estate.
The filing read, “There is a need for an administration because there are taxes that have to be filed, real property which must be administered, royalties that have to be distributed, etc.”
As In Touch first reported, a couple of weeks after Shelley’s death, Dan filed a petition in court naming himself Shelley’s “surviving common law spouse.”

Dan said he had been with Shelley for 35 years, but they never got married. Shelley and Dan moved to Texas in the mid ‘90s after she decided to leave Hollywood.
Dan told the court that he and Shelley “had an agreement to be married and demonstrated an intention to create a present, immediate and permanent marital relationship.”
In his filing, Dan said Shelley owned property worth in excess of $100,000. The actress owned a Texas home that sat on 10 acres of land. Shelley did not have any children but had three brothers: Shane, Stewart and Scott Duvall.
Dan asked the court to award him 100 percent of community property, 50 percent of separate real property and 100 percent of community and separate property.
He proposed that Shelley’s three brothers each be awarded 1/6th of Shelley’s separate real property. Shelley’s brother Shane quickly objected to Dan’s petition.
He denied Dan was a “surviving spouse” or that Dan should receive a cut of Shelley’s estate. Shane said the only beneficiaries of Shelley’s estate were him and his two brothers, Scott Duvall and Stewart Duvall.
He asked that the court award each brother 1/3rd of Shelley’s real and personal property. Shane said that “Dan Gilroy has no interest in [Shelley’s] property.”

Shelley’s other brother Stewart filed documents asking to be named administrator of the estate.
In court documents, it was revealed on top of her home worth $600,000, Shelly had $50,000 in the bank, other personal items and received minor royalty payments.
During the court battle, Shelley’s third brother Scott passed away, He died on November 18, 2024, in Texas.
After her death, Shelley’s longtime partner told TMZ that he found the actress unresponsive in their home the morning of her death. Dan told the outlet that the actress had been under hospice care and bedridden for months.
Dan later told The Hollywood Reporter, “My dear, sweet, wonderful life partner and friend left us. Too much suffering lately, now she’s free. Fly away, beautiful Shelley.”
