Elon Musk’s Alleged Ex Ashley Sued Mystery Man Before Paternity Battle

Ashley St. Clair, the woman who claims she gave birth to Elon Musk alleged 13th child, was involved in a custody battle over another child months before she sued the billionaire, In Touch can exclusively report.
Ashley, a 26-year-old conservative influencer, battled the father of her son Sebastian in a case entitled Anonymous v. Anonymous.
The court records show the case was filed on May 1, 2024, in New York Supreme Court. The “plaintiff” in the 2024 case appears to be Ashley due to the “plaintiff” having the same lawyer as the lawyer who filed Ashley’s case against Elon, 53.
The defendant in the 2024 case was listed as “anonymous” and was represented by a high-powered New York law firm.
The case was sealed but the court docket shows the parties had a ton of back and forth. The case was disposed in November 2024.
The father of Sebastian is unknown.
As In Touch previously reported, earlier this month, Ashley filed her suit against Elon demanding custody of their alleged child named R.S.C. Ashley asked the court to award her sole and legal custody of the child.
She said the child and her 3-year-old first-born, S.N.A., live in New York together. She said she began a romantic relationship with Elon in May 2023.
She said she had intercourse with him on January 2 and January 3, 2024. She said the sex occurred in St. Barths, “during which time our child was conceived.” Ashley said she gave birth to the child in 2024.

She wrote, “I was not married to [Elon] or any other person at the time of the child’s conception and subsequent birth. I am not currently married to [Elon] or any other person. I did not have sexual intercourse with any other male during the time the child was conceived.”
In her petition, she wrote, “Since R.S.C.’S birth, [Elon] has met him only three times and has had no involvement in his care and upbringing. I am the only parent to make decisions for R.S.C. I schedule and take him to all his medical appointments. I am the only parent who cares for him on a daily basis. I feed him, bathe him and ensure that all his physical and emotional needs are met.”
Ashley claimed that Elon was not present for the birth of the child, “has had no more than three in-person visits with our child and has not expressed an interest in having custody of our child.”
The influencer claimed Elon first met their child on September 21, 2024, in New York City for two hours. She said he also spent one hour visiting the child and her the next day. Ashley wrote, “The next, and last time that [Elon] saw our child was on November 30, 2024, in Austin, Texas, for only thirty minutes.” She included a photo of Elon with the child from one of his visits.

Her petition added, “[Elon] has never asked to see our child on any other occasion, he has never communicated to me about our child without my prompting, he has never asked for photos of our child or checked in after doctor’s appointments.”
She noted in her petition that she was a party to the other case with her ex. Ashley demanded Elon submit to a DNA test and custody be set by the court.
Elon has yet to respond to the claims publicly or in court.
Days after filing her suit, Ashley spoke to People about her lawsuit.
“This has never been about money for Ashley,” Ashley’s rep told the outlet. “This is about protecting the best interests of Ashley and Elon’s child from a man who can’t be counted on to even communicate, much less act consistently in the role of a father.”
“Mr. Musk spends more time on his own social media platform talking about his children’s mothers than talking to them,” the rep continued. “We tried to handle this collaboratively with Mr. Musk, but it takes both a father and a mother to do that, and he refused all conversations.”
